About this course

This course is designed to help students understand how TREC-promulgated contract forms are used in Texas real estate transactions and why careful form use is an important part of competent license-holder practice.

Contract forms are more than blanks on a page. They document the parties’ agreement, create rights and duties, establish deadlines, allocate risk, identify required notices and disclosures, and help move a transaction from offer to closing. A Texas sales agent must understand the general purpose of these forms, know when a form may be needed, and recognize when a transaction issue requires broker or professional guidance.

Throughout this course, students will study the major contract forms, common addenda, notices, amendments, termination forms, temporary leases, disclosure-related documents, and supporting forms that appear in residential real estate practice. The course will focus on how these forms are selected, how they connect to transaction facts, and how license holders can avoid common mistakes.

The main purpose of this course is to build practical contract-form judgment. Students should not simply memorize form names. They should learn how to read the facts of a transaction, identify the issue, choose the appropriate current form when applicable, and know when additional guidance is needed.

This course also reinforces the limits of a license holder’s role. A Texas sales agent may explain the general purpose of a promulgated form and complete forms using the parties’ instructions, but the agent must not draft custom legal language, interpret legal consequences, decide disputed rights, or give legal advice. Students will practice recognizing when broker, attorney, lender, title company, inspector, HOA, environmental, or other professional guidance is appropriate.

Another purpose of this course is to support exam readiness. The course connects contract-form practice to tested areas such as contract law, offer and acceptance, financing, title and survey, disclosures, settlement, possession, addenda, amendments, termination, earnest money, fair housing, fraud and misrepresentation, unauthorized practice of law, and Texas promulgated forms.

By the end of the course, students should be better prepared to approach contract forms with accuracy, caution, and confidence. They should understand that good form use protects the parties, supports broker supervision, promotes consumer protection, and helps license holders stay within the limits of their authority.
